Kosovo is American
"Kosovo is Serbia" slogan is one of the key to any political statement in Belgrade and meeting Serbia's diaspora around the world. The Orthodox monasteries throughout the country seem to demonstrate this point of view. "Kosovo is Albanian territory", is the response of the majority of 1.9 million people who live in this area. The their proof seems to be based on the amount of simple ethnic majority, which - incidentally - not necessarily has to do with one state. "Kosovo is European," is the declaration of the Brussels authorities, which underline the fact that Kosovo is part of the 'Eurozone' and is under surveillance of the EU. Historically, Serbs, ethnic Albanians, the periphery of Europe economically. Yes and no. However, geopolitics, Kosovo is the United States.
On July 22, 2010, 10 out of 14 judges of the International Court of Justice (ICJ) in The Hague have approved the declaration of independence of Kosovo as compatible with the rules of international law. Independence was declared on February 17 2008 by an "Assembly of Kosovo" in the parliament in Pristina. The statement dell'ICJ hath been limited to the proclamation of independence and does not address the legality of secession. This is a minor contradiction. A more serious contradiction is that the Kosovo Assembly in the parliament at the time was (and still is) not formally representing Kosovo in the international arena. UN Resolution 1244 of 1999, which indicated a "Special Representative of the Secretary-General as the official representative of the province, which is defined as an integral part of Yugoslavia and Serbia respectively. To put it precisely: The parliament of Kosovo was not authorized to represent Kosovo on the international scene. Under international law, no body had asked for legal independence. In its press release of the International Court of Justice, you can read the legality of the 'Assembly of Kosovo, which declared its independence: "At this point, the Court concludes that the authors of the declaration of independence ... not acted as one of the Provisional Institutions of Self Government in the constitutional framework, but rather as people who have acted in their capacity as representatives of the people of Kosovo, outside the framework of the interim administration (..) The authors of the Declaration ' independence were not bound by the framework of the established powers to govern (...)". Pertanto, la Corte Internazionale di Giustizia, "rileva che la dichiarazione d'indipendenza non ha violato il quadro costituzionale". In altre parole: poiché l'organismo che ha dichiarato la propria indipendenza non si compone di rappresentanti legali del Kosovo, le norme del diritto internazionale non erano state violate. Questa è una grave contraddizione.
La Corte internazionale di giustizia con il suo verdetto, di fatto segue la posizione degli Stati Uniti e della maggior parte degli stati UE. L'alleanza occidentale aveva già provato, prima della dichiarazione di indipendenza, di attuare una cosiddetto "indipendenza sotto sorveglianza" delle Nazioni Unite. Il piano Ahtisaari è stato liquidato dalla Russia (e dal Sud Africa). Così Washington, Paris, London and Berlin, have developed this plan without a UN mandate.
De jure, UN Resolution 1244, is still valid. Kosovo is therefore part of Serbia and the UN administration officially a neutral status. The use
all'ICJ raises the question of the independence of the state at international level. And it was Serbia that has requested it. So Belgrade can not simply ignore the verdict of the ICJ. Repeat the slogan "Kosovo is Serbia" will not help to overcome his defensive position. Not to mention the Serbian refusal to take into account the reality in Kosovo. 90% of the population is not prepared to accept the Serbian national emblems. This fact can not be ignored.
